Rental Registry Information and FAQs

Eective April 19, 2024, the City of Concord adopted an amended Residential Tenant Protection Program Ordinance to increase “just cause” eviction protections, expand the City’s Rental Registry, and establish a rent stabilization program. The goal of the new regulations is to stabilize the community and minimize displacement of residents, while also allowing property owners to make a fair return on their investments

Pursuant to Concord Municipal Code Chapter 19.40, the City must expand the rental registry. All landlords with rental units that are fully covered or partially covered by the Residential Tenant Protection Ordinance must complete and submit registration forms for each rental unit each year and pay the annual Rental Registry Fee.  Fully covered units are those that are subject to both Rent Stabilization and Just Cause for Eviction provisions of the Ordinance. Partially covered units are those that are only subject to Just Cause for Eviction provisions of the Ordinance. The annual rental registration fee is $47 per fully covered unit and $29 per partially covered unit.

The added Rent Stabilization and Just Cause for Eviction provisions have amended the data collection process whereby we can now collect data in real time. The City has newly contracted with 3Di, Inc. to administer the program and oversee the collection of data. As a result, within this first year of the augmented program, we will be asking for rent and tenancy information as of July 1, 2023 and July 1, 2024. Owners are required to register and pay the Rental Registry Fee beginning on November 1, 2024, but no later than December 31, 2024. Starting in 2025, owners will only be required to report one fiscal year at a time and pay the fee by July 1st of each year.

Property owners must also update the following information in the Rental Registry portal as they occur in real-time:

  • Termination of tenancy notices and any required supporting documentation (uploaded within 7 days of serving tenant)
  • Ellis Act Forms
  • Change in property ownership (within 30 days of change in ownership)

All residential rental units fully or partially covered by the Residential Tenant Protection Program Ordinance must be registered. This includes units that are subject to the rent stabilization provisions AND units that are subject to the Just Cause for Eviction provisions. Most residential rental units in Concord are covered under the Ordinance and must be registered.

Online

Owners may register their units by going to the online Rental Registry portal. We highly encourage online registrations to avoid any delays in your registration and payment processing.

Mail

If you are unable to register via the Rental Registry website for any reason, you may register by completing the registration forms found at www.cityofconcord.org/rentprogram under the forms tab and returning them to Concord’s Rental Registry Program. Please note that submission of paper forms may cause significant delays in processing the registration information and/or associated payments.   

Appointment

You may request assistance with registering your unit by making an appointment with Rent Registry staff. Please schedule your appointment online at www.cityofoncord.org/rentprogramappointment or by phone at (925) 671-5070 Monday through Thursday from 10 a.m. to 3 p.m. Appointments will be held at the Concord Senior Center located at 2727 Parkside Circle, Concord, CA 94519.

Most owner-occupied units are exempt from the Residential Tenant Protection Program Ordinance. If you received a letter to register and you occupy your home, then you should claim your unit exempt from the Rent Registry so as not to receive further registration communications. Owner-occupied units do not need to pay the Rent Registry Fee but should register and claim an exemption.

Owners can claim these units exempt by creating an account in the online Rental Registry, using the APN/PIN information included in the registration letter. Until and unless you claim an exemption, the City will assume your rental unit is subject to the registration and Rent Registry Fee and may commence enforcement actions for failure to register.

If your single-family home or condo becomes available for rent, you are required to register the unit and pay the annual Rent Registry Fee. Failure to register and pay the fee may result in penalties and fines.

If the single-family home or condo is rented, then it is covered under the just cause for eviction provisions and should be registered.

If the owner lives in the house as their primary residence and shares a bathroom or kitchen with the tenant(s), then the owner should register and claim an exemption in the Rent Registry portal.

According to the Ordinance, 19.40.020(b)(3) “Rent Restricted Affordable Units” are partially exempt (not subject to the Rent Stabilization provisions but subject to the Just Cause for Eviction provisions if they are: “Either restricted by the City or other governmental agency as affordable housing for persons or families of very low, low, or moderate income, as defined in Section 50093 of the Health and Safety Code if any are subject to one of the following Rent increase restrictions: (i) Rent increases equal to or less than five percent (5%) annually and enforceable by the City or other governmental agency pursuant to a deed, regulatory restriction contained in an agreement, or other recorded document, or (ii) for certified over income Tenants, Rent increases in an amount less than or equal to those permitted under Civil Code Section 1947.12(a)(1) until/if AB 846 (amending Health and Safety Code Section 50199.24 (Low income housing credit: rent increases)) is enacted, in which case the provision of the latter shall control, provided that Tenants are not charged Rent in excess of thirty percent (30%) of the household monthly income.

Yes, properties that do not have these restrictions will be subject to the allowable rent increases provided by the Rent Stabilization provisions in the Ordinance.

Units covered with a tenant holding a Housing Choice Voucher are subject to the Rent Stabilization and Just Cause for Eviction provisions. Project Based units in a building owned by the government are exempt from the Rent Stabilization provisions.

To register a unit, property owners must have the Assessor Parcel Number (APN) and unique pin number associated with their property. This information was provided in a letter that the Rent Registry Program mailed to the address associated with the property owner.

To register a unit, you will need to enter information about the rental unit, the property owner and/or manager, and the tenancy. Information that will be collected in the Rental Registry includes:

Section 1: Property Information

  • Address (if different than the property address provided above)
  • Unit Number
  • Property type – (Single Family Residence/Condominium Rental Unit (1 rental unit), Multifamily Building (2 Rental Units or more), Affordable Housing, Mobilehome)
  • Date Certificate of Occupancy was Issued

Section 2: Unit Status as of July 1, 2023

  • Unit Status (Rented or Vacant)
  • Rent as of July 1, 2023
  • Amount charged for services – included with rent (electricity, natural gas, cable, Wi-Fi, Garage, Recycling, Water, Sewer, Garbage, Common Area Maintenance, Parking, Storage, Other)

Section 3: Unit Status as of July 1, 2024

  • Unit Status (Rented or Vacant)
  • Rent as of July 1, 2024
  • Amount charged for services – included with rent (electricity, natural gas, cable, Wi-Fi, Garage, Recycling, Water, Sewer, Garbage, Common Area Maintenance, Parking, Storage, Other)

Section 4: Rent Rollback

Section 5: Tenancy Changes by Tenant

  • Tenancy Start Date – What is the Move-In date of the current Tenant?
  • Type of Lease – 12 Month, 6 Month, or Month-to-Month Lease
  • Initial Rent Amount
  • Amount of Security Deposit
  • Number of occupants
  • Current Rent Amount – Monthly rent amount for the current tenant at time of registration
  • Date of Last Rent Increase
  • Amount of Last Rent Increase
  • Number of Assigned Parking Spaces
  • Date of Owner Move – In (If Unit is Owner Occupied only)
  • Services Included with Rent
  • Total dollar amount of services included with Rent

Section 8: Tenant Information

  • Tenant’s First and Last Name
  • Tenant Phone Number (if known by the property owner)
  • Tenant Email Address (if known by the property owner)
  • Tenant Preferred Language

The annual rental registration fee is $47 per fully covered unit and $29 per partially covered unit. Please see question #2 above to see which units are covered by the Residential Tenant Protection Program Ordinance.

Units that are exempt from the Residential Tenant Protection Program Ordinance (i.e. owner-occupied units, units unavailable for rent) will not be charged the Rent Registry Fee.

After registering your rental units, the Rent Registry portal will generate an invoice for the fee owed in the 2024-2025 registration year. You may pay the fee using a credit card or electronic check in the Rental Registry portal.

Property owners are responsible for complying with the Residential Tenant Protection Program Ordinance. If by February 28, 2025, their covered rental units are not registered with the City and the property owner is delinquent in registry fees, accrued interest, fines and penalties pursuant to Section 19.40.060, property owners will be prohibited from:

  • Imposing allowable annual rent increases
  • Filing a Property Owner Petition for Fair Return

Additionally, to the extent permitted by law, any violation shall be a defense to an unlawful detainer.

The City may commence enforcement actions against any landlord who fails to register a rental unit and pay the Rent Registry Fee by February 28, 2025.
